The first-instance verdict against the commander of the infamous Third Corps of the Army of the Republic of Bosnia and Herzegovina, Sakib Mahmuljin, was revoked by a decision of the Appellate Chamber of the Court of BiH.
This information for N1 was confirmed by the law firm of Vasvija Vidović, who represents Mahmuljin.
Mahmuljin was previously sentenced to 10 years in prison, and the indictment alleges that during the war in BiH, the armed conflict between the Army of RBiH and the Army of Republika Srpska in the municipality of Zavidovići, the accused Sakib Mahmuljin, in his capacity as commander of the 3rd Corps of the Army of RBiH, which included the detachment for the ceremonial slaughter of the heads of BH citizens “El Mujahidin,” during 1995, while the military operation of the Army of the Republic of Bosnia and Herzegovina in the broader area of Zavidovici and Vozuca, within which members of the detachment “El Mujahidin” committed war crimes against prisoners of war and Serb civilians in the area, did nothing to prevent the crime, although he had information that members of this detachment were preparing to commit a crime and that after the crime he did nothing to punish the perpetrators.
The Court for War Crimes charged Mahmuljin with committing war crimes against prisoners of war, war crimes against the wounded and sick, and war crimes against civilians.
At the plea hearing held on 4 February 2016 before the War Crimes Chamber of the Court in the Sakib Mahmuljin case, the accused Sakib Mahmuljin pleaded not guilty to the following criminal offenses: war crimes against prisoners of war, war crimes against the wounded and sick and war crime against civilians.
The law office also told us that the Appellate Chamber of the Court of BiH also said a hearing in this case, but it was not specified when it would take place.
